Communicating the posting of a worker abroad

Whenever an employer sends a person to do a specific job in another country, inside or outside the European Economic Area (EEA), for a limited period of time, this person is considered to be posted abroad.

Attending a meeting, congress, trade show or other similar event is not classed as a posting.

The employer must communicate the posting to the Working Conditions Authority (ACT).

The Working Conditions Authority (ACT) must be informed at least five days before the job posting abroad starts.

If there are changes after this, you do not need to send a new communication to the ACT.

What are the documents and requirements to communicating the posting of a worker abroad?

The employer must provide the following information on the ACT form:

  • identity of the service provider
  • number and identity of the worker(s) to be posted
  • planned duration and planned start and end dates of the posting
  • address(es) of the place of work
  • nature of the services that justify the posting, etc.

There are more requirements for a temporarily posted worker than for a non-temporary worker. These include:

  • the licence issued by the IEFP (Institute of Employment and Vocational Training)
  • the guarantee to the IEFP for the use of workers abroad
  • the guarantee of medical, pharmaceutical and hospital services in the host country.

To communicate the posting, you will need to follow the steps below.

  1. Access the appropriate form for the type of worker you want to post:
  2. Sign in and complete the appropriate form.
  3. Send the form to the ACT.
  4. You will receive proof of submission of the form at the email address that you provided.
