Portuguese Associations and Cooperatives - Renewal of the public utility status
Portuguese associations and cooperatives can request the renewal of the public utility status.
Note: Portuguese foundations and the permanent representations of foundations or other foreign non-profit legal entities must make the requests at the corresponding services.
This renewal request does not apply to the annual submission of activity reports and accounts or the transmission of statutory changes. For this purpose, a request for Legal Notices must be filed.
Entities with public utility status must previously submit a request for a Communication of Interest in maintaining the Public Utility Status to revalidate the status for another ten years. One year to six months before that deadline they must submit a renewal request.
Procedure and requirements
Time of issue/decision
Prazo de apresentação: entre um ano e seis meses antes do fim do estatuto. Em caso de apresentação fora do prazo estabelecido ou na falta de apresentação do pedido de renovação, o estatuto caduca.
Prazo de decisão: previsto no artigo 128.º do Código do Procedimento Administrativo.
Se não houver decisão dentro desse prazo, há deferimento tácito. O prazo (à data da entrada em vigor da LQEUP) é, em regra, de 90 dias úteis, mas pode ser prorrogado, mediante autorização expressa do decisor, por até mais 90 dias.

Obligations
Os deveres gerais das pessoas coletivas de utilidade pública estão previstos no n.º 1 artigo 12.º da Lei-Quadro do Estatuto de Utilidade Pública.
