Industrial establishment – reporting the suspension of activity

The suspension of the activity of an industrial establishment for more than one year must be reported by the registered owner of that establishment. This service allows the suspension of activity in mainland Portugal to be reported to the coordinating entity.

Who can report the suspension of activity of an industrial establishment

Suspension of activity must be reported by the registered owners of the industrial establishments covered by the Responsible Industry System (Sistema da Indústria Responsável, SIR) and located in mainland Portugal.

If the industrial establishment is located in the Azores or Madeira autonomous regions, the regional websites must be used for reporting. Go to the Azores industrial licences website or, for Madeira, the Regional Directorate for Economy and Transport website.

When can you report the suspension of activity of an industrial establishment

The suspension of activity must be reported to the coordinating entity within 30 days of the suspension of activity.

How to report the suspension of activity of an industrial establishment

The suspension of activity can only be reported online.

To report a suspension of activity, you will need to take the following steps:

  1. Go to the reserved area of the Responsible Industry System (SIR) and log in using your Digital Mobile Key (CMD) or Citizen Card.
  1. Click on the relevant company/establishment and choose the ‘Comunicação de Suspensão de Atividade’ (‘Report suspension of activity’) service
  2. Complete the form and submit it. You do not need to attach any documents when submitting the form.

After submission, the coordinating entity will review the report and, if necessary, may ask for more information. If everything is in order, the entity will send you a notification confirming the suspension of activity.

What is the maximum period for a suspension of activity?

If a type-1 industrial establishment has been inactive for more than one year but less than three years, the applicant must submit an inspection request before resuming operations.

If the activity of an industrial establishment has been suspended for three years or more, the operating permit will lapse and the resumption of activity is subject to the rules governing new installations.

Ways of contesting a decision

In accordance with Article 83.º-A of the SIR, all formal documents issued in the licensing process – such as licences, permissions, opinions and approvals – may be contested in court.

These documents have legal standing and may be the subject of legal proceedings, in accordance with Article 51 of the Code of Procedure of the Administrative Courts.
