In type 1 establishments, the recommencement of activity, after a period of inactivity of more than one year and less than three years, is subject to prior inspection.

The inactivity of an industrial establishment for a period equal to or exceeding three years causes the operating license to expire. In such cases, the recommencement of activity is subject to the discipline imposed on new facilities.
 

Ways of contesting a decision

In accordance with Article 83.º-A of the SIR, all formal documents issued in the licensing process – such as licences, permissions, opinions and approvals – may be contested in court.

These documents have legal standing and may be the subject of legal proceedings, in accordance with Article 51 of the Code of Procedure of the Administrative Courts.
