The pregnancy termination allowance is a sum of money paid to the employee to compensate for the lack of income due to the medically certified termination of her pregnancy.

The allowance is paid for by Social Security in either one or two instalments, depending on the duration of leave indicated by the doctor.

The following women are entitled to the pregnancy termination allowance:

  • employees
  • self-employed people
  • those covered by the voluntary social insurance scheme
    • national seafarers and lookouts working on ships belonging to foreign companies
    • national seafarers working on vessels of fishing joint ventures
    • crew members working on vessels registered in the International Shipping Register of Madeira (MAR)
    • scientific research fellows
  • those in pre-retirement who are working under any of the aforementioned schemes
  • beneficiaries of unemployment benefit or social unemployment benefit
  • beneficiaries of a relative invalidity pension or a survivor’s pension, as long as they are working and paying Social Security contributions.

Requirements

The following conditions must be met to be eligible for the allowance:

At the start of your period of leave, you must have worked, with remuneration records, for at least 6 months, either consecutively or intermittently.

You are on sick leave due to the termination of your pregnancy.

If you are self-employed or covered by the voluntary social insurance scheme, your Social Security payments are up to date on the day on which your entitlement to the allowance is recognised.

If your employment contract is terminated or suspended, the pregnancy termination allowance can still be paid, provided that no more than 6 consecutive months have elapsed without you paying Social Security contributions between the date of the suspension or termination of your contract and the date of the termination of your pregnancy.

To access Social Security Direct, you will need to sign in using one of the following means of authentication:

To apply for the pregnancy termination allowance, follow the steps below:

  1. Log in to Social Security Direct (SSD)
  2. In the menu, choose the ‘Família’ (‘Family’) option and click on ‘Parentalidade’ (‘Parenthood’)
  3. Then click on ‘Pedir novo’ (‘New application’) and select ‘Subsídio por interrupção da gravidez’ (‘Pregnancy termination allowance’)
  4. Complete the form with the information indicated
  5. Attach all the necessary documents
  6. Submit the form.

How much will pregnancy termination allowance will I receive?

You will receive 100% of your reference remuneration for a period of between 14 to 30 days, depending on the medical indication.

What is my reference remuneration?

Your reference remuneration is the average of your Social Security payments for the first 6 months of the last 8 months before you were unable to work, excluding holiday and Christmas bonuses.

In situations where the reference remuneration is very low, the law sets a minimum limit of EUR 13.58 per day. You then multiply the EUR 13.58 by the number of days (between 14 and 30) indicated by the doctor.

If you reside in one of the autonomous regions, the pregnancy termination allowance is increased by 2%.

  • survivor’s pension (as long as you are working and paying Social Security contributions)
  • pensions or indemnities for occupational accidents or illness
  • income support supplement
  • solidarity supplement for the elderly
  • pre-retirement with suspension of employment, provided that there you are carrying out an activity subject to Social Security deductions.
