Terms and conditions of use

The A Minha Rua service is managed by the Agency for the Technological Reform of the State, IP, hereinafter referred to as ‘ARTE’.

This service allows citizens to report various situations relating to public spaces to a local authority, which will inform them of the process and possible resolution of the problem.

Before accessing and using this service, please read its terms and conditions of use carefully. Access to and use of this site by the user is considered an unequivocal sign that the user has read, understood and accepted these terms and conditions of use. These terms and conditions may be amended at any time by decision of ARTE, with the amendments taking effect from the date of their publication on the gov.pt portal.

Any attempts to alter the information, or any other action that may cause damage and jeopardise the integrity of the system, are strictly prohibited in accordance with current legislation.

It is forbidden to use the contents of this service for illegal purposes or any other purposes that may be considered unworthy or abusive. The creation or introduction of any type of virus or other code or programme containing destructive properties or harmful to its operation is also prohibited.

The user of this service undertakes to scrupulously comply with the applicable legislation, particularly with regard to computer crime and intellectual property rights, and is solely responsible for any infringement of these regulations.

All content, including any videos, graphics, text, images, drawings, music or sounds and any other information is the property of ARTE, or has been included with the permission of the entities that legitimately hold the copyright over it.

The protection of copyright and industrial property rights over the contents of the service extends to all copies of part or all of the information contained therein.

Privacy Policy

ARTE respects your right to privacy and does not collect any personal information about you on this service without your consent.

In all matters not expressly provided for, ARTE's Privacy Policy applies.

In order to use this service, it may be necessary to collect your personal data for the purposes indicated, as detailed below:

  • Purpose 1: so that the municipality can contact the citizen to ask for further clarification or to provide information on how to resolve the problem

The data collected will be kept for the periods indicated below:

The personal data collected is shared with the local authority to which the problem is reported.

Taking into account the latest technological developments, implementation costs, nature, scope, context and purposes of the processing, as well as a detailed assessment of the risk, likelihood of occurrence and respective impact on the rights and freedoms of data subjects, ARTE has implemented technical and organisational measures with the aim of guaranteeing the appropriate level of security.

Cookies and cookies policy

Use of the A Minha Rua service is subject to the cookies and cookies policy applicable to the gov.pt portal.

Release from liability

ARTE cannot be held liable for any losses or damages in civil liability (including, but not limited to, consequential damages, loss of profits and moral damages, caused directly or indirectly), arising as a result of the correct or incorrect use of this service and its contents by the user, or access to the user's computer and computer system by third parties.

Users are responsible for the safekeeping and correct use of their personal information, as well as for any damage or harm caused to ARTE or third parties as a result of the incorrect use, loss or theft of personal information. Users are responsible for the secure use of their credentials to access the services.

The information contained in this service shall be regarded as informative. Despite ARTE's efforts to keep the contents up to date and reliable, they may contain inaccuracies, writing errors or be out of date and ARTE shall not be liable for the complete accuracy and timeliness of any information on this service.

This service may contain links to Websites operated by third parties over whom it has no control and for which it assumes no responsibility.

The viewing of legal provisions on this service does not dispense with consulting the legal regulations in force, officially approved, published in the original editions and media (including the Official Gazette or the Official Journal of the European Union).

Applicable legislation and regulations

Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).

Law no. 58/2019, of 8 August, which ensures the implementation of the GDPR in the national legal order.

The service provided is subject to the Non-contractual Civil Liability Regime of the State and Other Public Entities, in accordance with Law 67/2007 of 31 December, in its current wording, and the limitation period for the right to compensation under it, in accordance with Article 5 thereof, is determined in accordance with Article 498 of the Civil Code, which establishes a maximum period of 3 years.

Applicable law and jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with Portuguese law.

The Court of the territorial area of Lisbon, to the exclusion of any other, shall have jurisdiction to settle any disputes arising from the interpretation and application of these Terms and Conditions for the use of this service.
